To obtain a mining permit in Oregon, operators need an Operating Permit from the Oregon Department of Geology and Mineral Industries (DOGAMI) if they intend to mine over an acre or extract more than 5,000 cubic yards of material annually. The process begins with submitting an application, which includes a detailed reclamation plan and an outline of mining activities. This plan ensures that environmental impacts are managed and the land will be restored post-mining. (Please note, that other permits and land use approvals need to be obtained from other agencies as well. We will discuss this in future blog posts.)
In addition to the application, DOGAMI requires proof of ownership or legal authorization to mine on the proposed site. Financial assurances must also be provided, serving as a reclamation bond to cover restoration costs if the operator fails to fulfill reclamation obligations. The amount of financial assurance is determined based on the proposed mining impact and anticipated reclamation costs.
The permitting includes coordination with other state and federal agencies to address water, air, and wildlife considerations. Certain supplemental forms/ information are required when the plans include impact to sensitive areas such as wetlands. The plan must demonstrate compliance with the Clean Water Act, air quality standards, and wildlife conservation guidelines. DOGAMI performs site inspections regularly to ensure these standards are met throughout the operation's lifespan.
Once mining concludes, reclamation must be completed according to the approved plan, transforming the site into a stable, natural state. After verifying that all reclamation requirements are met, DOGAMI will release the financial assurance and close the permit. This thorough approach ensures responsible mining practices while preserving Oregon’s environmental integrity.
